First Plea Filed in Supreme Court Against Waqf Amendment Bill

New Delhi, April 4—Congress MP Mohammad Javed moved the Supreme Court on Friday, challenging the Waqf Amendment Bill 2025, marking the first legal challenge against the legislation.

His petition comes a day after the Rajya Sabha passed the bill, following its approval in the Lok Sabha. It now awaits presidential assent.

Javed, who also serves as the Congress whip in the Lok Sabha, argued that the law violates fundamental rights and religious freedoms. “This legislation discriminates against Muslims and undermines constitutional protections,” he said.

Filed through advocate Anas Tanvir, the petition claims the bill contravenes multiple constitutional provisions, including Article 14 (right to equality), Article 25 (freedom of religion), Article 26 (right to manage religious affairs), Article 29 (rights of minorities), and Article 300A (right to property).

“The amendments impose restrictions on the Muslim community that are not found in laws governing other religious groups,” Javed stated. “This selective approach goes against the very spirit of the Constitution.”

With the petition now before the Supreme Court, legal scrutiny of the Waqf Amendment Bill is set to intensify.
