Chandigarh, Dec 5: A Dadumajra resident has been awarded two years of rigorous imprisonment after a Chandigarh court ruled that he was found carrying an illegal country-made pistol during a police naka in January 2022. The court said the evidence showed the accused, Kuldeep Kumar, “was in conscious possession of the weapon.”
Police told the court that ASI Shamsher Singh was patrolling near the DMC dumping ground on January 18, 2022, when he received information about a man with an illegal firearm heading toward DMC Park. “We acted on the input without delay and started checking vehicles and pedestrians,” ASI Singh said.
Kuldeep was stopped during the checking and a pistol was allegedly recovered from his person. With no licence presented at the spot, Maloya police registered a case under the Arms Act.
Six prosecution witnesses testified during the trial. Kuldeep, however, claimed innocence, telling the court under Section 313 CrPC, “The police have framed me. I was not caught at any naka, and the weapon was planted on me.”
The court ruled that the prosecution version stood supported by witness statements and the recovery memo, leaving “no room for doubt.” During sentencing, Kuldeep sought leniency on the grounds that he is poor and supports his family. The court refused, sentencing him to two years’ rigorous imprisonment and a ₹2,000 fine.
