Chandigarh, Nov 29: The Punjab and Haryana high court has struck down Chandigarh’s school-based eligibility rule for MD/MS admissions at GMCH-32, directing the administration to follow institutional preference for filling UT quota seats.
A bench of Justice Ashwani Kumar Mishra and Justice Rohit Kapoor said the UT’s plan “cannot have the court’s approval,” noting that the Supreme Court has already ruled that residence- or descent-based reservation in PG medical courses is “not permissible.”
The UT had framed a policy requiring candidates to have completed Classes 10 to 12 from Chandigarh-recognised schools. The court said the rule “appears impermissible,” but allowed the administration to revise its policy “consistent with Supreme Court judgments.”
The petition was filed by a student who said the Chandigarh quota rules illegally amounted to domicile reservation. GMCH-32 offers 150 MD/MS seats, equally split between the all India quota and the UT’s state quota.
