Apex Court Orders Intelligence Review for Hawara Prison Transfer

Security Considerations Prioritized in Plea to Move Assassination Convict to Punjab

by TheReportingTimes

NEW DELHI, OCT 13: The Supreme Court directed authorities to gather security inputs from the Intelligence Bureau regarding the requested jail transfer of Beant Singh murder case convict Jagtar Singh Hawara. Justices MM Sundresh and PB Varale emphasized that judicial decisions in such high-profile matters must carefully weigh intelligence evaluations provided by state and central agencies. Hawara remains lodged in Tihar Jail following his re-arrest after a high-profile prison breach in 2004.

State counsel affirmed that both the Delhi Government and the Home Ministry have consistently opposed shifting Hawara out of the national capital due to potential security risks. Legal representatives for the petitioner argued that Hawara has been acquitted in nearly all other pending matters and requires proximity to Punjab to effectively participate in remaining legal proceedings. Defence counsel further noted that Hawara’s co-accused in related cases are currently serving sentences in high-security facilities within Punjab.

Acknowledging the complex nature of managing high-risk prisoners, the Supreme Court deferred the matter to allow intelligence agencies sufficient time to submit their findings. Legal experts declared that the upcoming input from central intelligence will form a vital basis for the Bench when determining the outcome of the petition.
