According to reports reviewed by the Haryana Human Rights Commission, the patient arrived at the Sector 3 Primary Health Centre seeking immediate admission for labor pains. Finding the facility’s perimeter gates closed and encountering no available medical or security staff to assist her, she was compelled to give birth in an open public area outside the clinic grounds while family members attempted to locate a wheelchair.
The panel took up the matter this week, stating that the situation appeared prima facie inhuman and raised critical concerns regarding the state’s maternal safety networks. The investigation focuses heavily on potential violations of constitutional protections that safeguard individual health and emergency medical care.
“An incident of this nature undermines public faith in our basic health infrastructure,” a senior commission representative maintained during the initial review. “We are investigating the precise breakdown in facility protocols that left a vulnerable patient without immediate access to an open emergency room.”
The inquiry aims to determine how the facility failed to fulfill the mandates of the Janani Shishu Suraksha Karyakram, which funds and guarantees safe medical environments for expectant mothers. Investigators are examining shift logs and staff attendance records from the night of the incident to identify why the facility was inaccessible during a medical emergency.
Justice Lalit Batra has demanded comprehensive accountability statements from the state’s highest health authorities, including the regional clinic supervisor and the Faridabad Civil Surgeon. The directives require the department to clarify the structural failures and provide arguments regarding financial penalties for human rights violations. The commission scheduled the next formal hearing for August 19, 2026, setting that date as the final deadline for the medical reports.
